The EB5 visa provides a pathway to permanent residency (Green Card) for the investor, their spouse, and unmarried children under 21. This visa is ideal for individuals seeking to contribute to the U.S. economy through substantial investment and job creation.

L1

The L-1 visa is a non-immigrant visa for employees of international companies transferring to a U.S. office, subsidiary, or affiliate. There are two types: L-1A for managers and executives, and L-1B for employees with specialized knowledge. To qualify, applicants must have worked for the foreign company for at least one year within the past three years. The L-1 visa allows multinational companies to move key employees to the U.S. to manage operations or apply their specialized knowledge. The L-1A visa is valid for up to 7 years, while the L-1B visa is valid for up to 5 years.

O-1A

The O-1A visa is a non-immigrant visa for individuals with extraordinary ability in science, education, business, or athletics. To qualify, applicants must demonstrate sustained national or international acclaim and recognition in their field. They need to provide evidence of their achievements, such as awards, publications, or high salaries. Unlike some other visas, the O1A requires a job offer from a U.S. employer and a petition filed on the applicant’s behalf.

O-1B

H-1B

The H-1B visa allows U.S. companies to hire foreign workers in specialty occupations requiring specialized knowledge and at least a bachelor’s degree. While it is commonly used in fields like IT, engineering, and healthcare, it is available to qualified professionals in all areas. The visa is valid for up to three years, extendable to six years. Employers must sponsor the visa and pay the prevailing wage. Due to an annual cap, applicants must participate in a lottery system. There are 65,000 visas available, plus an additional 20,000 for individuals with a U.S. master’s degree or higher, with the lottery selecting petitions for processing.

E-2

The E-2 visa is a non-immigrant visa for investors and entrepreneurs from countries with which the U.S. has a treaty of commerce and navigation. To qualify, applicants must invest a substantial amount of capital in a U.S. business and demonstrate that they will develop and direct the enterprise. The business must be a bona fide enterprise, meaning it is real, active, and operating. The E-2 visa allows investors, their spouses, and children to live and work in the U.S. as long as the business is operational. This visa is renewable indefinitely as long as the business continues to meet the requirements.

P-1

The P-1 visa is a non-immigrant visa for internationally recognized athletes, entertainers, and performers coming to the U.S. temporarily to participate in a specific event, competition, or performance. The visa requires a job offer or an engagement from a U.S. employer, agent, or sponsoring organization. This visa is suitable for professional athletes, sports teams, and entertainment groups looking to showcase their talents in the U.S.

K-1

The K-1 visa is a non-immigrant visa for foreign fiancés of U.S. citizens, allowing them to enter the U.S. for the purpose of getting married. To qualify, the couple must have met in person within the past two years and intend to marry within 90 days of the fiancé’s arrival in the U.S. Once the K-1 visa is approved, the foreign fiancé can travel to the U.S. and marry the U.S. citizen sponsor within the 90-day period. After marriage, the foreign spouse can apply for adjustment of status to become a lawful permanent resident (Green Card holder). The K-1 visa provides a pathway for couples to be together in the U.S. and transition to permanent residency.
